Academic Medical Center Financial Relationships

An exception to the Stark law must be complied with to permit physician referrals of DHS to an academic medical center (including a hospital, faculty practice plan and other components), including for inpatient or outpatient hospital services and other forms of designated health services where the referring physician or family member has a financial relationship with the academic medical center. 

The precise exception that will be available will depend upon the nature of the financial relationship involved (e.g., ownership, compensation or both, provision of services, lease of space and/or equipment and others).  In most instances the exception for academic medical centers will be used to permit financial and referral relationships with referring physicians -- although other exceptions can and will frequently be relied upon.
