Stark in 30 seconds

Stark Law enforcement.  There have been a number of Stark law enforcement actions in recent years.

The first involved a settlement in 2001 by a Boston-area medical group. The medical group agreed to pay $230,000 to settle federal civil charges based on alleged Stark law violations.  The medical group, Pastor Medical Associates, Brookline, Mass., was alleged to have improperly submitted claims to the Medicare program seeking payment for clinical laboratory tests. The government alleged that Pastor physicians violated the Stark law because they had compensation arrangements that directly linked each physician’s compensation to the value of his/her laboratory service referrals.

There have been many additional settlements based on violations of the Stark law and violations of other laws since the Pastor settlement, most of which have occurred as a result of whistleblower suits.
