Orthopedics medical practice suite

The Stark law applies to orthopedic practices in a variety of ways, including the following relatively common activities:

  • The delivery of plain-film X-ray, magnetic resonance imaging (MRI) and similar diagnostic services that are furnished and billed by the orthopedic practice;
  • The delivery of physical therapy services through the practice;
  • Medical director and similar service arrangements by orthopedic surgeons with hospitals, and physician referrals to such organizations for inpatient and outpatient hospital services;
  • Lease and service arrangements with physical therapy providers; and
  • Joint-venture arrangements with hospitals and other providers.
